Terms & Conditions

By creating an account at app.aiphagy.com, or using any part of the Aiphagy service, you agree to these terms. If you don't agree, don't use the service.

1. The service

Aiphagy is a humanization layer for AI character production. We provide software that orchestrates third-party generation APIs and applies proprietary refinement on top. The service is currently in private beta; features, limits, and pricing may change.

2. Your account

You're responsible for keeping your credentials secure and for all activity under your account. You must be at least 18 years old to use the service. One human per account; sharing credentials is not allowed.

3. Bring-your-own-key (BYOK)

Generation costs (raw image, video, and audio generation, and similar) are billed directly to your accounts with the underlying AI providers. You provide your API keys; we don't mark up provider fees. You're responsible for understanding and complying with the third-party providers' terms of service.

4. Acceptable use

You agree not to use the service to:

• Impersonate real, identifiable individuals without their consent
• Generate sexual content involving minors, or non-consensual sexual content of any person
• Create deceptive political or election-related content
• Produce content intended to defraud, harass, or defame
• Violate any law or third-party rights, including intellectual property
• Reverse-engineer, scrape, or attempt to extract our model weights, prompts, or proprietary engine logic
• Run automated workloads that exceed reasonable use of the platform without prior written agreement

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.

5. Your content

You retain ownership of the characters, prompts, generated media, and data you create or upload. By using the service, you grant Aiphagy a limited license to host, process, and display your content solely as needed to operate the service for you.

You're responsible for ensuring you have the rights to any content you input (reference images, voice samples, etc.).

6. Our content

Aiphagy's software, brand, written content, and proprietary refinement logic are owned by us. You receive a non-exclusive, non-transferable right to use the service while your account is active.

7. Billing

Subscriptions are billed monthly or annually in advance via Stripe. Refunds are not standard but may be granted at our discretion for service interruptions or other documented issues.

You may cancel at any time from your account settings. Cancellation stops future billing but does not refund the current period.

8. Service availability

We work to keep the service highly available, but we don't guarantee uninterrupted operation. Scheduled maintenance, third-party outages (Cloudflare, Railway, Neon, AI generation providers), and force-majeure events may cause downtime. We aren't liable for losses caused by unavailability beyond offering a pro-rated credit at our discretion.

9. Disclaimer & liability

The service is provided "as is", without warranties of any kind, express or implied. We don't warrant that generated content will be accurate, legal, suitable for any purpose, or free of synthetic artifacts.

To the maximum extent permitted by law, our total liability for any claim arising from your use of the service is limited to the amount you paid us in the 12 months preceding the claim.

10. Termination

Either party may terminate the relationship at any time. Upon termination, your access ends and your data is retained for 30 days before permanent deletion (unless you've requested earlier deletion).

11. Governing law

These terms are governed by the laws of the jurisdiction in which Aiphagy is incorporated. Any disputes will be resolved in the courts of that jurisdiction. The specific jurisdiction will be confirmed at general availability launch and updated here.

12. Changes

We may update these terms. Material changes will be communicated by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
